Syracuse, NY - A Syracuse man who helped set up and carry out a home-invasion robbery during which a suburban woman was sexually assaulted was sentenced today to 20 years in state prison.
Onondaga County JUdge Anthony Aloi imposed the sentenced after rejecting Jayson M. Kelley's request to withdraw his guilty plea to felony counts of first-degree burglary and first-degree robbery.
Kelley, 26, of 1802 W. Genesee St., muttered obscenities throughout the proceeding, repeatedly interrupting the judge and Assistant District Attorney Melinda McGunnigle.
He refused to sign or acknowledge an order of protection for the victim. He also refused to sign a waiver of appeal, tearing up the document and throwing it to the courtroom floor.
Aloi told Kelley he deserved every minute of the 20-year sentence he agreed to in a plea deal.
The charges stem from a July 24 home invasion in Minoa during which the woman resident was raped and sexually assaulted by two of the intruders in front of her 5-year-old daughter.
McGunnigle acknowledged Kelley was not involved in sexually assaulting the victim. But the prosecutor pointed out it was Kelley who recruited the two accomplices who did sexually assault the victim and drove them to the scene in his father's vehicle.
Kelley never had any contact with the woman during the incident because she knew him and would have been able to identify him, McGunnigle said.
Aloi noted Kelley's belligerent attitude proved he'd learned nothing from the incident and his prosecution.
Given a final opportunity to speak before the sentence was imposed, Kelley muttered another round of obscenities aimed at the victim, her daughter and McGunnigle.
The accomplice who raped the resident, Darron Phillips, 25, of 113 Thurgood Terrace, Syracuse, was sentenced last week to 25 years in prison for first-degree rape and first-degree burglary in an obscenity-laced sentencing proceeding.
Justin D. White, 25, also of 113 Thurgood Terrace, is facing a sentence of 22 years after pleading guilty last month to first-degree burglary and first-degree criminal sexual act.
Aimee D. Burton, 19, of East Syracuse, is facing a sentence of no more than 3½ years in prison after pleading guilty to attempted second-degree burglary.
Anthony M. Griffin, 31, of Mattydale, is facing trial July 19. The prosecution contends he was the mastermind behind the home-invasion incident who recruited Kelley to carry out the break-in and robbery for him.
