UTICA, N.Y. -- An Oneida County judge denied a request to move the trial of a Blossvale man accused of shooting and killing his 3-month-old son in front of state troopers to another location.
Adam Theall, 21, pleaded not guilty to second-degree murder charges in July. State police called to the town of Vienna home of Theall’s mother for a domestic disturbance June 22 witnessed Theall shoot his son, Eithen, with a long gun. Troopers returned fire when Theall refused to drop the weapon.
This morning, Judge Michael Dwyer called the motion for change of venue “premature” and said he would only reconsider if it was “overly difficult” to select a jury. Last month, Dwyer denied a request from Theall’s attorney for an exam to determine his client’s competency to stand trial.
A hearing on statements Theall made to police officers is scheduled for Sept. 30. His trial is set for Nov. 29.
