Syracuse, NY – A Fabius woman will be freed from the Onondaga County Correctional Facility pending the outcome of an appeal of her sentence for driving while ability impaired.
County Judge William Walsh this morning granted a stay of Maura B. Quinn’s sentence while the appeal is decided.
Quinn, 44, was sentenced Oct. 5 to serve three years’ probation and 45 days at the Jamesville jail after a Pompey town court jury convicted her of DWAI and third-degree aggravated unlicensed operation of a motor vehicle. She began serving the sentence Wednesday.
Defense lawyer Jeffrey Leibo contends that the sentence imposed by Pompey Justice John Voninski is excessive and illegal. He says the DWAI was a violation carrying a maximum penalty of one year on probation and 30 days in jail.
The district attorney's office argues that the DWAI became a misdemeanor because Quinn has at least two prior DWAI convictions. Misdemeanor DWAI is punishable by up to three years' probation and as much as 90 days in jail.
