New Hartford, NY - A watermelon-smashing incident at a local Wal-Mart store overnight led to an Oneida County man being charged with driving while intoxicated.
New Hartford police Officer Christopher J. Burns said the vehicle Nicholas S. LoGalbo Jr. was driving was stopped in the parking lot of Consumer Square near the Michael's store about 3:25 a.m. today because a passenger in the vehicle reportedly had smashed a watermelon on the floor at the Wal-Mart store and fled.
LoGalbo, 20, of Whitesboro, was issued appearance tickets charging him with DWI and second-degree aggravated unlicensed operation of a motor vehicle.
The passenger, who was not identified by police, was detained but not charged after Wal-Mart authorities declined to file criminal charges, police reported.
