Syracuse, NY - A Syracuse man already registered as a sex offender was sentenced today to eight years in prison for sexually molesting the daughter of his friends while staying at their home.
Eugene Hayes, 45, said he was sorry for the incident which he blamed on his abuse of alcohol and drugs. Onondaga County Judge Anthony Aloi said that was no excuse for the conduct.
Hayes, for whom authorities listed addresses on Tompkins Street and Park Avenue, pleaded guilty last month to first-degree criminal sexual act for the Feb. 5 incident. Authorities said Hayes was staying with friends when they found him in bed performing a sex act on their 7-year-old daughter.
Hayes already was a Level 2 sex offender based on a 2007 misdemeanor conviction for sexual misconduct involving an 18-year-old female..
Aloi today sentenced him to a concurrent penalty of one to three years in prison for failing to report a change of address as required for a registered sex offender.
Defense lawyer Thomas Marris asked Aloi to postpone sentencing for a couple of weeks for Hayes to continue getting medical treatment as a local inmate. Marris and Hayes told the judge Hayes recently was diagnosed with prostate cancer.
Aloi denied the request, noting Hayes could get any necessary medical treatment in state prison.
