A Blossvale man accused of shooting his 3-month-old son with a shotgun awaits the action of the Oneida County grand jury after waiving his appearance in Floyd court Tuesday.
Adam Theall, 21, of 167 Pine Haven Circle, was charged with second-degree murder Saturday night.
On June 22, state police were called to the home Theall’s mother for a domestic dispute. When they arrived, Theall stepped out on the front porch with a long gun and shot his infant son. Troopers returned fire when Theall refused to drop the weapon. He suffered 14 to 16 bullet wounds but was released from Upstate University Hospital last week.
Theall was due to appear at a preliminary felony hearing in Floyd Court Thursday afternoon, where prosecutors would have presented evidence that he committed a crime. Floyd Town Judge Christopher Clarkin approved Theall’s written request to waive the appearance.
The case will now be considered by the Oneida County grand jury. Theall remains incarcerated at the Oneida County Correctional Facility without bail.
