A legal complaint claims that new electronic voting machines to be used in New York State this year have a design flaw that could lead to thousands of votes being thrown out.

The lawsuit says the error known as “over-voting” invalidates the incorrect part of the ballot when a voter accidentally picks too many candidates for a particular race.

The Brennan Center for Justice at the New York University School of Law is set to file the suit on Monday. It represents a number of advocacy groups, including the NAACP and Working Families Party.

The groups say that nonnative English speakers would lose their votes in disproportionate numbers.

The state Board of Elections said a trial run of the machines Upstate last year produced no major problems.
